Judge Rules Charlie Kirk Murder Suspect Must Stand Trial, Death Penalty Still on the Table

A Utah judge ruled Tuesday that Tyler Robinson will stand trial in the killing of conservative activist Charlie Kirk, and left the death penalty on the table as the case moves forward.

The Ruling

Utah District Judge Tony Graf ordered the case to trial on all counts, including aggravated murder, felony discharge of a firearm causing serious bodily injury, obstruction of justice, tampering with a witness, and a violent offense committed in the presence of a child. Graf found prosecutors presented what he called “overwhelming” evidence that Robinson fired the fatal shot, and ruled there was sufficient basis that Robinson knowingly created a risk of death to bystanders nearby, the aggravating factor required to keep the death penalty on the table.

The Evidence Presented

Prosecutors pointed to DNA linking Robinson to a bolt-action rifle and an engraving tool, a bullet inscribed with a message referencing Kirk, a handwritten note in which Robinson allegedly wrote that he had the opportunity to “take out” Kirk and took it, text messages, Discord posts, and video showing Robinson accessing the rooftop where the shot was fired.

The Defense’s Argument

Defense attorney Staci Visser argued against the bystander-risk finding, telling the court, “There is one shot. There is one bullet. There is one victim. There is zero evidence that there was any action taken towards other people.”

What Happened

Kirk was shot once in the neck in September 2025 while addressing a crowd at an outdoor event at Utah Valley University in Orem, hosted by his organization Turning Point USA. Prosecutors say Robinson, 23, fired from a rooftop more than 400 feet away. He turned himself in the following day, posting online beforehand, “it was me at UVU yesterday.”
